Sticky Notes reserves the right to amend these Terms at any time, and it is your responsibility to review them regularly to stay updated on any changes. These Terms comply with Australian Consumer Law (ACL), and nothing here limits your rights under the ACL.
Use of Website and Customer Obligations
By accessing our website, you agree to use it responsibly and in accordance with all applicable laws. You must ensure that any information you provide to us, including order details and artwork, is accurate, complete, and submitted in a timely manner. You agree not to use the website for any unlawful purposes or activities that could harm the operation of the website.
Product Availability and Variations
Sticky Notes strives to keep our product offerings updated, but product availability may change without notice. Certain products may be discontinued, replaced, or unavailable due to supplier issues or changes in demand. Additionally, minor variations in colour, size, or material may occur between production batches, which are standard within manufacturing processes.
Placing Orders and Communication
All purchase orders must be submitted in writing, typically via email. This ensures clarity regarding product choices, customization, and delivery details. Verbal orders should always be followed by written confirmation to prevent any miscommunication. It is essential that clear instructions are provided when placing an order, including all necessary branding and customization details.
Submission of Artwork for Custom Products
Customers are responsible for submitting artwork in accordance with the guidelines provided on our website. If the artwork does not meet these specifications, production delays or substandard results may occur. Sticky Notes is not liable for any issues arising from artwork that does not comply with these guidelines.
Review and Approval of Artwork
Before production begins, Sticky Notes will provide a digital mockup of the design for the Customer’s approval. It is the Customer’s responsibility to review this proof for accuracy. Once the mockup is approved, no further changes can be made, and production will proceed based on the final approved version. Approval of the mockup confirms the Customer’s acceptance of the design and any associated details.
Colour Matching and Custom Branding
Sticky Notes will make every effort to match PMS colours as closely as possible. However, due to the differences in materials and printing surfaces, slight variations in colour may occur. The Customer acknowledges that perfect colour matching may not always be feasible and accepts these potential variations when placing custom orders.
Quantity Variations in Custom Orders
Custom orders may experience a variation in the final quantity delivered, with a tolerance of ±5%. This is due to the production process, and the final invoice will reflect the actual quantity delivered. The Customer will be billed accordingly.
Rush Orders and Additional Charges
If the Customer requires expedited production or delivery, additional charges may apply. Rush orders will be processed as a priority but are subject to stock availability and production capacity at the time of the order.
Shipping and Handling
Freight and handling fees will be applied to all orders and are included in the final invoice. Sticky Notes takes all necessary steps to ensure products are securely packaged and shipped promptly. However, we are not responsible for delays, damage, or loss caused by third-party courier services or factors outside of our control. Shipping information and tracking details will be provided upon dispatch.
Ownership and Title of Goods
Sticky Notes retains ownership of all goods until full payment has been received. Once payment is completed, ownership transfers to the Customer upon delivery. Until the full payment is confirmed, Sticky Notes retains the right to withhold delivery of the goods.
Inspection of Goods and Reporting Defects
It is the Customer’s responsibility to inspect the goods upon delivery. Any defects, discrepancies, or issues must be reported within seven days of receipt. While this timeframe ensures a timely response, it does not affect the Customer’s rights under Australian Consumer Law, which allows a reasonable period to return faulty goods. Goods must be returned in their original condition and packaging for assessment. Sticky Notes will then decide whether to issue a replacement, repair, or refund.
Refunds, Defects, and Warranties
Sticky Notes will honor all applicable consumer guarantees under Australian Consumer Law. In the event that a product is faulty or does not match its description, the Customer is entitled to a repair, replacement, or refund. Returns must be arranged at the Customer’s expense unless otherwise agreed. Custom-branded products are generally non-refundable unless a defect is found.
Payment Terms and Methods
Full payment is required before production can commence, unless otherwise agreed in writing. Sticky Notes accepts direct bank transfers with no additional fees. Payments made via credit card (Visa, Mastercard, American Express) will incur a 1.75% merchant fee, reflecting the actual cost of processing.
Late Payments and Debt Recovery
Late payments may incur additional fees. If payment is not received by the due date, Sticky Notes reserves the right to engage debt collection services, and the Customer will be responsible for any associated legal or recovery costs. All actions taken will comply with Australian law regarding debt collection.
Order Cancellation and Amendments
Orders cannot be canceled once production has commenced unless agreed upon in writing by Sticky Notes. If a cancellation is accepted, the Customer may be charged for any work already completed. Requests to amend orders must be made in writing, and additional charges may apply if modifications require extra work or resources.
Limitation of Liability
Sticky Notes is not liable for any loss, damage, or additional expenses resulting from circumstances beyond our control, including but not limited to transportation delays, supplier issues, or natural disasters. Our liability for defective products is limited to repair, replacement, or refund, as required under Australian Consumer Law.
Exclusion of Implied Warranties
To the extent allowed by law, all implied warranties are excluded. Sticky Notes will pass on any applicable manufacturer warranties to the Customer where relevant. However, the Customer’s rights under Australian Consumer Law, including guarantees related to the acceptable quality and fitness for purpose of goods, remain unaffected.
Governing Law
These Terms and Conditions are governed by and will be interpreted in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of New South Wales.
By placing an order with Sticky Notes, the Customer acknowledges and agrees to these Terms and Conditions and confirms that their rights under Australian Consumer Law are fully preserved.
